We are a gift basket company dedicated to creating thoughtful, curated gifting experiences. Our product catalog includes gift baskets containing perishable and non-perishable items, assembled and delivered with care.

To bring you the widest selection and the best quality, our inventory may be sourced through a combination of in-house fulfillment and trusted third-party partners. In some cases, we operate under official distributor agreements with partner brands. Regardless of the source, every product sold through our store is offered under our name and is subject to our quality standards and these Terms of Service.

By accessing our website, browsing our store, or completing a purchase, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms of Service along with our Privacy Policy, Shipping Policy, and Returns & Satisfaction Guarantee.

If you do not agree with any part of these terms, please do not place an order. We reserve the right to update these terms at any time. Continued use of our store following any changes constitutes your acceptance of the revised terms.

Placing an order through our store constitutes an offer to purchase. Your order is not confirmed until you receive a written order confirmation from us via email. We reserve the right to decline or cancel any order at our discretion, including in cases of pricing errors, product unavailability, or suspected fraud.

We are proud to work with a curated network of fulfillment partners and, in certain cases, hold official distributor agreements with brands whose products appear in our baskets. This allows us to offer a diverse and high-quality product range while maintaining full accountability to you as our customer.

• Some or all products in a given order may be sourced from or fulfilled by a third-party partner on our behalf.
• All partner-fulfilled products are held to the same quality and presentation standards as our own.
• Our distributor agreements are between us and our suppliers. They do not create any rights or obligations between you and those suppliers directly.
• We do not disclose the identity of specific fulfillment partners as this constitutes proprietary business information.

Payment is collected in full at the time of purchase. We accept major credit and debit cards as well as any additional payment methods displayed at checkout. All transactions are processed securely through our payment provider.

By providing your payment information, you represent that you are authorized to use that payment method and authorize us to charge the full order amount including applicable taxes and shipping fees.

Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms of Service by reference. By placing an order, you also agree to the terms of our Shipping Policy.

You are responsible for providing an accurate and complete delivery address at checkout. We are not liable for failed deliveries, delays, or loss resulting from an incorrect or incomplete address. Redelivery fees, where applicable, are the responsibility of the customer.

Many of our gift baskets contain perishable items with a limited shelf life. By placing an order, you acknowledge and accept the perishable nature of these products and agree to the following:

• Perishable items should be consumed or refrigerated promptly upon delivery.
• We are not responsible for spoilage resulting from delayed pickup, improper storage, or delivery to an unattended location for an extended period.
• Delivery date requests are accommodated on a best-effort basis. Exact delivery dates cannot be guaranteed due to carrier variability.
• For gift deliveries to third-party recipients, it is your responsibility to ensure someone will be available to receive and properly store the basket.

Some of our gift baskets may contain alcoholic beverages, including wine, spirits, or other liquor products. By purchasing any basket that includes alcohol, you represent, warrant, and agree to all of the following:

• You are at least 21 years of age or older, as required by United States federal law and the laws of your state.
• The intended recipient of the gift, if different from the purchaser, is also at least 21 years of age.
• You understand that the purchase, possession, and consumption of alcohol is subject to applicable federal, state, and local laws, and you agree to comply with all such laws.
• Alcohol-containing orders may only be delivered to addresses in states where such delivery is legally permitted. We reserve the right to cancel any order if delivery to the destination address is prohibited or restricted under applicable law.
• Delivery of alcohol-containing orders may require the signature of an adult aged 21 or older at the time of delivery. If no eligible adult is available to sign, the carrier may be unable to complete delivery.

We reserve the right to request age verification documentation at any time prior to or upon delivery. We are not liable for any consequences arising from a customer's misrepresentation of their age or the age of the intended recipient, or from the customer's failure to comply with applicable alcohol laws.

Our Returns & Satisfaction Guarantee policy governs all claims related to damaged, missing, or unsatisfactory orders and is incorporated into these Terms of Service by reference.

Due to the perishable nature of our products, we do not accept physical returns. However, we are committed to making every situation right. If you are dissatisfied with your order for any reason, please contact us within 48 hours of delivery with supporting documentation and we will work with you to find a fair resolution.

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the site. You may not:

• Use automated tools, bots, or scrapers to access or extract data from our website without written permission.
• Attempt to gain unauthorized access to any part of our systems or infrastructure.
• Use our website to transmit spam, harmful content, or any material that is unlawful or misleading.
• Reproduce, duplicate, copy, or resell any part of our website or its content without express written consent.

We reserve the right to restrict or terminate access to our website for any user who violates these terms or engages in behavior we deem harmful to our business or other customers.

All content on our website — including text, images, logos, product descriptions, graphics, and design elements — is our property or used under license and is protected by applicable intellectual property laws. You may not use, reproduce, or distribute any content from our website without our prior written consent.

Third-party brand names, trademarks, or logos that appear in connection with products we carry are the property of their respective owners. Their appearance on our site does not imply any affiliation beyond our distributor or reseller relationship.

Our products and website are provided on an "as is" and "as available" basis. While we strive to maintain accurate product descriptions and imagery, we do not warrant that product descriptions are error-free or that the visual representation of products will exactly match what is delivered, as gift basket contents may vary slightly based on availability.

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or related to your use of our store or the purchase of our products shall not exceed the total amount paid by you for the order in question.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of enjoyment, emotional distress, or costs incurred as a result of a delayed or failed delivery, even if we have been advised of the possibility of such damages.

These Terms of Service are governed by the laws of the United States and the state in which our business is registered, without regard to conflict of law principles. Any dispute arising from these terms or your use of our store shall first be addressed through good-faith communication with our customer service team.

If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with applicable rules, and both parties waive the right to a jury trial or class action proceeding, to the extent permitted by law.
